我和太太出生在中國，目前都是加拿大公民。太太持TN一直在美國工作已經20多年。我以前也是TN, 但最近幾年轉為TD。兒子在美國出生，剛滿21歲，準備幫我們申請依親綠卡。有三個問題想請教8老師：

1.未婚兒子還在一所美國大學讀書，幾乎沒有收入。目前我們同兒子還是一個家庭，住在一起（美國）。請問我太太的收入可以做為擔保收入嗎？如果可以，太太去年的稅單可以作為證明嗎？

-Yes. Because your spouse has worked in US for more than 10 years (40 quarters of SSA coverage), you and your spouse only need to file I-864W, respectively (you can use your spouse work credit for your I-864W by providing your marrige certificate). So, your kid does not need to file I-864.

Your spouse needs to provide the copies of tax return and W2 of 2024, the employment verification letter from her employer with I-864W filing. She also needs to create an account online from SSA website and print out the list of her working history with the income of each year and provide it with I-864W filing.

You also need to file I-864W and provide the copies of your spouse's support documents above including your marriage certificate.

I-864W needs to be filed together with your I-485 and your spouse's I-485, respectively.

2.在遞出I-130和I-485後等待期間，我太太還能以TN繼續在美國工作，而我還能繼續持有TD嗎？

-Yes, but both of you had better not leave US until you get the green card. if you or your spouse want to leave US during I-485 pending, you or your spouse need to have approved advance parole, but your spouse cannot work using TN and must use EAD to work if she leaves US using advance parole. If you want to work before you get green card, you also can apply for EAD.

So, you and your spouse may apply for advance parole and EAD together with I-485 filing, but it will cost you a lot of money. EAD and advance parole applications are optional, so if you do not need it, you may not need to waste your money.
