8老師，我的PD-May2016 EB2Perm(公司關門）. 現在又申請NIW.剛去年10月遞出要9-12個月獲批。現在是我幾個問題。 （1）兒子大學一年級想實習。想把H4轉換成F1. 但律師說F1有移民傾向不建議轉。我咋辦？

-What the lawyer said is incorrect. It is fine for your kid to change his H4 status to F1 status. Your I-140 filing is irrelevant to your kid, only related to you. In other words, your kid has no immigrant intent until he files his I-485. So, just talk to his school International Student Office to do the status change.

-You had better file I-485 until your NIW I-140 is approved which will have the priority date ported from your old I-140. If you file I-485 during the NIW I-140 pending,, USCIS may feel confused and reject your I-485. Discuss this issue with your lawyer if you want to file I-485 during the NIW I-140 pending.
