請教8老師，現在申請EB2中，今年初140才批準，現在的H1b身份在今年9月就到了六年，H1b renew是8月份交上去的，還沒有批下來，但是現在公司下個月要裁員，如果我要換工作，是否要等到現在H1b renew批準以後才可以轉公司，如果在renew批準下來前就被裁員的話，是否就out of status，並且不能轉H1b去新的公司？
-You need to get the H-1 extension approved before you get laid off (if any) because your 6-year H-1 has ended. Then, you can change the employer and do H-1 transfer using the approved I-140. You may ask your current employer to use the premium processing to get the H-1 extension approved within 15 days, thus you can feel safe. If the employer does not want to pay thye premium processing fee, you may pay it by yourself because it is very important to you to get the extension approved as soon as possible.
