我的NIW 485等了很久都沒有消息。我聽說有時候因為種種原因或者是因為出錯，NIW 485 有可能被拒。我想先作好準備如果萬一NIW 485被據，及時appeal 或 motion to reopen，那麽在appeal或motion to reopen期間，我該怎麽保持身份？

我現在還在h1b extension期間，但是我用了AP回國，所以應該屬於AOS. 

-Your status is Parolee if you use AP to travel, but you can still use the H-1 benefits. Thus, you don't need to  use EAD to work and you also can extend your H-1 or transfer H-1 to reinstate your H-1 status within US.
