又來請教８老師，這次是代我朋友問。他人在國內，符合特殊人才綠卡的申請要求。現在美國訪問，可以在美國遞交申請。下麵是我們的問題：

1. 在美國加州遞交傑出人材綠卡申請後, 通常多長時間綠卡能被批準?  比直接在中國申請快嗎？
-If he uses premium processing for I-140 and his qualification is very strong, it may be approved in about two weeks. But because there is 排期 in EB-1 currently, he cannot file I-485 in US now. So, it is difficult to say how long he can get the green card.

2. 聽說今年五月份移民局有新政策出台, 導致這類綠卡申請等待時間長至5年, 是否屬實?
-No.

3. 在美國遞交申請後, 他人一定要留在美國等待嗎?
-Not necessary. 

如果中間回國長期居住, 對他的申請有哪些負麵影響?
-No. But he had better find a job in US when he applies for the immigrant visa in China

他的Case會被轉到廣州使館嗎?
-Yes, because it seems it is difficult for him to stay in US for a longer time currently,  he had better indicate this request in the Form I-140 so that USCIS will forward his case to NVC and to the US Consulate in China.
