EB2的140 已經批準, PD 5/14/10, 6年之外的3年H1_B 延期將在5/18/2015 到期, 目前3月排期是09/01/2015. 請問:

1. 如果在3月1同時遞交485和H1B延期申請, H1B的延期會批嗎?
-Yes.

是3年還是1年?
-Just ask for 3 years, but USCIS may approve it for one year if the PD is current when USCIS make decision.

2. 如果不申請H1B 延期, 隻用485 的EAD來工作, 會有什麽嚴重後果嗎?


3. 我覺得我的律師在這個問題上有點前後矛盾, 他先要求我辦H1B延期, 說這樣比較保險, 萬一485被拒或排期倒退也不會影響目前的工 作, 這樣的說法有道理嗎?
-Yes, but the chance of I-485 denial is small if you don't lose your current job.

4. 然後我說一旦拿到回美證就要用它回國時, 他又說用了回美證就代表放棄了H1B. 那我申請H1B延期還有什麽意義?
-What the lawyer said is not completely right. You still can use the H-1 benefits after using AP such as you can continue to work without using EAD, and you can extend your H-1 to reinstate your H-1 anytime. So, using AP does not affect you that much.
