老公h1b三個月前6年期滿，學校幫他申請o1 簽證，並說等簽證期間可以繼續工作。最近結果出來o1被拒了，所以相當於三個多月他在美國都沒身份，現在他打算回國簽證，可以簽 h4(因為我是h1), 或者簽 j1(學校支持的）。我想問像這種有一段時間在美沒身份停留的，回國再簽還有希望簽過嗎？
-If he filed O-1 application before H-1 expired, he was legally present during the O-1 pending. So, as long as he will go to China very soon, he should be fine to get the visa. Bring the last H-1 approval notice and the O-1 denial notice to prove his legal stay during the O-1 pending during the visa interview.

簽過了的話入關有問題嗎？ 如果有可能，是簽h4 還是j1 好？
-H-4 visa is easier to get than J-1 visa (he can change H-4 to J-1 within US later).
