I am a US citizen and have been trying to apply non-immigrant visa for parents.
The whole process went through smoothly till their interview in Guangzhou. They were asked for "proof of extention of last stay in the US".
My parents had stayed in the US for three years and left for China in 2007.
My understanding is that they cannot get into US before 2017, is it right?
-Yes due to the 10-year bar.
Are there anyways they can get their visa earlier?
-Normally no way.
May I find a means to keep their application case active till 2017, so that we donot need to start over from I-130.
-Their immigration visa application will be denied due to 10-year bar. But the I-130 is still valid. You can contact USCIS and NVC to reactivate your I-130 in the future.
Appreciate your help!
