8老師您好，非常感謝您總是耐心並熱心的回答大家的所有關於移民簽證的問題！

上次問您，我的H1B被withdraw on 5/9/2014，原以為能拿到的offer沒成，現正在找工作，可是心裏特沒底，我已經out of status了，不知道還可以留在美國境內多久來找工作？
-Because your I-94 does not expire, your stay in US is not counted as unlawful presence and that means you will not be subjected to 3 year or 10-year bar after you leave US. I have seen some people like you to find a job and then go back to China to get the H-1 visa. Of course, you have lost your status.

如果找到，打算馬上回國等他們辦H1B（這樣是不是安全點？），
-Fine.

在國內簽證時簽證官會不會直接就拒了因為逾期滯留？
-Possible, but I have known one person went to China and got the visa when he found a new job after he lost job for ten months.

 

我老公是H4，也在找工作，他的情況是不是和我一樣？
-Yes, same.
