Your file and check will be returned and the worst is if they already deposit your check before find out your file is earlier (even 1 day), then you need to receive the refund check first before you apply. Even one day earlier then 3 months before 5 years, you can't apply. Patience is needed, you can wait 4 and half years, just wait for 3 more months.
