我8 月26日 辭職，最後一張Pay 發於 8月9日， 8月27日申請H1 轉H4， 收據還未到， 8月30日找到新工作， 新單位說給辦H1， 可有幾個問題搞不清
1， 如果新單位辦 change employer, 那麽I-129 表part 2 #4 上可以填 到時轉H4 的收據號嗎？-No. Your status is not H4 yet.
填了不就看出我之前的Employer結束了， 那還能叫change employer 嗎？
- Use "change of employer". By the way, the I-129 is filed by your new employer, not you.
2. 如果I-129上完全不提轉身份之事， File了H1 後我withdraw 轉H4 的申請， 萬一我到時H1 出了意外， 沒批準， 那我8月26日後不就不合法留美了嗎？
-You had better withdraw the H4 in case it will mess up your status later. If the H1 approval don't have I-94, you just go to China to get the H1 visa to come back. However, I don't think your H1 transfer will have a problem because your last pay check stub was issued less than one month ago, and USCIS can not realize your have lost your job before you file the H1 transfer. Even if the ole employer ask USCIS to cancel the old H1, it still take some time for USCIS to do it (impossible to do it in such a short time before your file your new H1).
3. 還有一個選擇，不知合理嗎， 新單位辦 new employment , 然後I-129 表part 2 #4 上填 轉H4 的收據號， 可是這樣又覺得和新單位說時弄得太複雜
底應該是哪個啊， 或者還有更正確的做法嗎？
