回複：緊急求助H1B延期

請專家指點一下，我這種情況該怎麽辦？我的基本情況：

1）在學校做千老。下個月月底6年H1B到期。

2）NIW I140已經批了，去年12月的PD.

遇到的麻煩：

1）我這個工作的prevailing wage從前年的38k 漲到去年的70k，再漲

到今年的77k。我是幸運在去年這個prevailing wage以前申請的H1B

transfer。要是再延期H1b的話，隻能從full time 轉成成part time。

2）學校建議我搞O1A，個人覺得不夠格，因為沒review和awards，或

加入啥organizations。

 剛剛查了一下，發現學校搞visa的人用的是ACWIA的database 不是

all industries的database，學校到底應該用哪一個？用all industries

database我就不會有問題的，或者我換成另一個job category也不會有

問題。學校搞這個居然告訴我不可以換job catergory了。

請問：


1）搞part time H1B extension 會不會很risky？
-No.

part time會不會影響以後遞交485？-No, but your employer needs to provide a letter stating that they will offer you full-time position after you get the green card for your I-485 filing.

2）聽學校搞visa的人趕緊搞O1A？老板肯定不願意交4000刀。ISS

charge 那麽多刀。。。。並且沒有保證能成。

3）我究竟可以不可以換job catergory？-Yes and many people like you do that to meet the prevail wage requirement for H-1 petition. The person in the school normally does not know the immigration law well.
