回複：請教8老師，填I-485的犯罪記錄問題

 

請教8老師，我們的Eb1的I-140已經批準。準備DIY遞交I-485。但有關犯罪記錄的問題不清楚：我丈夫5年前因abuse我們的小孩，被法院判強製隔離12個月。在隔離期間接受心理輔導和abuse counseling. 6個月後我們全家又重新生活在一起。在整個過程中，他沒有被拘押和被捕的經曆。他再沒有其他不良記錄。

 

請教老師，1. 這個是不是犯罪記錄？


我在I-485申請是要不要提這個？
-Yes. Need to answer "Yes" to Part C 1.b. " Have you Ever, in or outside US,
b. been arrested, cited, charged, indicted, fined, or imprisoned for breaking or violating any law or ordinance, excluding traffic violations ".

Then explain the entire case in a separate piece of paper, and provide the copy of the related court documents about this case with I-485 filing.

 

                  2. 如果要報告我要交什麽材料？


會被拒嗎？-Should not.

 

                  3. 如果不提，移民局會不會認為我們不誠實，拒絕我們的綠卡申請？會不會給以後的公民申請留不良記錄？
