回複：請教8老師一個問題，我用過AP後，老婆來美，是否可以申請H4簽證

我已遞交485， pending狀態，排期2009年1月20日,申請過工卡，但沒用過，一直是以H1（學術類）身份工作, H1身份將於今年9月15日到期。今年4月回去結婚了, 回美國使用了AP。下麵的問題是：

1. 現在老婆來美，是否可以申請H4簽證？
-No.

還是我必須回去，重新簽次

H1, 攜帶她H4簽證。但這個很麻煩，盡量避免。
-Yes. You need to get the H-1 visa, then she can apply for the H-4 visa together with your H-1 visa application, or apply H-4 visa some time later after you enter US using H-1 visa.

 

2. 如果不行，怎麽辦？

要申請B1探親簽證，就有移民傾向，可行嗎？
-She can try it and you never know, but B2 status can not stay longer unless your PD will be current soon so that she can file I-485 before the B2 I-94 expires.

3. 如果她能申請H4來美，我的H1 9月15日身份到期後，為保證她的合法身份等到我的485排期，使她可以也遞交485，我可能再續H1，但她的I-94 能更換嗎？
