I-140 表格和付州外學費的問題

Can we enjoy the benefits of permanent residents after the I-140 form is filed? My kid wants to go to an out-of-state university. After she lives in that state for over one year, we can pay instate tuition if our I-140 form is accepted by USCIS?  Or it has to be ONE year after our I-140 form is accepted?
