我是加拿大護照，老公的H1b剛剛拿到批複I797延期3年附有新的I94.但是我的H4辦理I539的時候已經過期一周了。律師沒有和老公的一起申請。他說加拿大護照是不需要的。

現在看到網上辦理時間需要5個月，現在非常擔心。我是否屬於非法滯留？不過很幸運我換了新的駕照（有效期1年）。現在需要出境嗎？還是死等？謝謝！
-I suggest you to bring your spouse H1 approval notice and his recent 3 month paycheck stubs and your passport to the US-Canada border to get the H4 I-94 because your "H4辦理I539的時候已經過期一周了". Also bring your I-539 filing receipt with you though it is useless, just in case.
其實當初我的I94上的日期是錯的，它應該和老公的I797上的日期一致，對嗎？

但是卻少了半個多月。我們也是最近才發現的。我和兒子一起入境，都是H4,可兒子的是9月30日，我的居然是9月12日。真是莫名其妙？！
