昨天h1b批下來了，但沒有I-94.　公司律師說要全家一起回去中國簽證，理由是簽證官會說"Where is you wife?" Since she is out of status, we need her to come back before we can approve visa. 我希望我自己先回去，萬一拒簽的話，我妻子也可以在這裏處理一些房子等事務．律師的說法對不對呢？

-If you and your wife's old H-1 I-94 and H-4 I-94 do not expire yet, it is fine for you to go to China to get the H1 visa and your wife does not need to do it. Otherwise, both of you need to leave US to get the H1/H4 visa.
