h1b 8個月後找到新工作要petition,

因種種原因公司隻用regular process. 老的H1b I-94到明年4月才過期.
在這個petition交上去以後我是不是可以呆在美國等待approve再回中國簽證?

公司的律師說我要現在就回國在國內等,我看到過一個申請沒出結果以前是可以合法地待在美國的對吧?
他說"We have prepared your H-1B petition for consular processing", 這個跟一般的petition有什麽不同呢?
-This means you have to get the H1 visa in the US Consulate in China to come back to work becuase your status has a gap (e.g. you lost your job and not find a new job in time, etc.).
