1. 如果丟了工作, 是否必須立刻離境?

-Not necessary. If your H1 I-94 does not expire yet, you are legal to stay in US. So, just fine a job as soon as possible and do the H1 transfer. If your H1 transfer approval has no I-94 due to the status gap, just go outside US to get the H1 visa to come back.

To my understanding an H-1B holder will be out of status immediately once losing the job. Would you please provide a link which legally supports your statement “If your H1 I-94 does not expire yet, you are legal to stay in US.”?

 

 

2. 如果幸運3月排期到, 遞485申請後丟了工作,多長時間找到工作不影響拿GC?

-As long as USCIS does not send your RFE for your employment status, your I-485 is safe.

或者等找到下家再遞485?
