我是NIW類,主申請人, PD2007年7月,140 是2008年批的, 收到要我補充材料的信:
your current residency and work status in the US and your employer’s
verification that you have a permanent job in the US.
我的情況是 2010年接受了一個加拿大的研究所的工作, 因為就在邊境附近,加上我丈夫還在美國,就沒有轉到大使館, 經常回美國.
我該怎麽辦? 能說我正在美國找工作嗎?
或者回信說明我是NIW類, 不需要雇主支持, 可行嗎?
-You misunderstand NIW. NIW 不需要雇主支持 only means you do not employer to support your NIW I-140. You still need to have a job in US to be qualifed for the I-485 approval because your I-485 is employment-based (EB2 in your case). So, if you do not have a job offer in US to respond to this RFE, your I-485 probably will be denied.
我需要在3 月份回複. 即使我在這其間能找個和我專業相關的工作, 也沒有把握拿到employer’s verification 說我在美國有永久工作啊.
