回複：請問各位老師，排期馬上到了，我們這種情況是否應該立刻遞交485

請問各位老師，我們的排期是09年1月6日，主申請人是我老婆，生物領域的niw，現在的情況是，lp的老板馬上沒有funding了，已經告訴lp隻能工作到2012年2月9日，然後，允許lp從2月份到5月份休3個月的personal leave來保持h1b。正好我找到了另外一個城市的工作，現在我是opt，現在lp想趕緊和我一起過去在那邊找工作。

現在的情況是，估計下個月我們的排期就到了，應該可以在2月1日遞交我們的485申請，

第一，如果可以遞交的話，請問，我們這種情況還可以遞交麽？

-Yes, but the problem is that if USCIS send your wife's RFE for her employment status and she has no job, ehr I-485 probabaly will be denied.

因為我lp的雇傭終止在2012年的5月份（從2月10日開始休personal leave）。

 

第二，我們這種情況是不是應該等到我lp找到新工作辦好新的h1b再遞交申請呢？

-I think so. She can file her I-485 anytime as long as her find a job in the same/similar area. 

第三，是否我們也可以馬上在2月1日遞交485申請，等待ap和ead，這樣我lp就可以不再依賴h1b了，可以從從容容的找工作了呢？

-My suggestion is that she had better not file I-485 at this point and look for a job at least until May 2012. Also, as long as her I-94 is valid, she still can stay in US legally without a status for < 180 days without affecting the I-485 filing. So, she may not need to file I-485 before May 2012 unless she find a job before that date.

但是這樣的話，是否要出示雇傭證明？

-Must need 雇傭證明 for NIW I-485 filing even if she wants to file I-485 now.

如果到時候沒有找到新的工作，是否會有極大的風險呢，多謝各位老師了
