Please help. My green card application category is EB3, and has submited 485 in July 2007. My hu*****and has 485 submitted as dependent too. later, his company did green card application for him with category EB2 and got 140 approved. The company is not doing well, and he may have to leave company within one month. It is not too hard for him to find a similar job. But there is one probem with the green card application:
once he starts a new job, does he need to redo his immigration application starting from perm? - 如果被 laid off 了 ...
I know that if he has submitted his 485 as main applicator before and has a new higher category 140, he doesn't need to do anything and just write a letter once his PD is current.
But since his 485 is based on my perm, can he use the approved 140 from old company and ask for transfer? - No, unless his PD is current (I-485 被拒若幹例 4)
