You may still come back even you are asked for backgroud check. But you better contact US consulate in Canada to make sure it is the case.

By the way, since your J1 will expire shortly and your H1b has not start yet. It will be difficult to get a new visa for either one now. It will be better if you apply a H1b visa stamp just before your H1b starts.
