回複：準備父母移民，但是父親隻拿到一個月在美居留，能否申請

我父母今年二月來美後決定移民。父親４月回國辦理公證。但是再次入境時候，Ｉ－９４隻給一個月，月２日前必須離境，而且一年內不能再次入境。

我能否在７月２日前遞交移民申請，

-He had better file I-485 two to three months later. His unlawyful presence does not affect his I-485, anyway (had better not travel within US before filing I-485 in this case). Both your parents can apply for the AP at the same time with the I-485 filing and use the AP to travel to China if they want to.

 

我父母是否可以合法在美居住。

-Yes, after they file I-485. Of course they can file their I-485 together with your I-130 filing (concurrently).
