I am a Canadian. I485被拒 in 2009 (J1簽證, 沒有WAIVER).  H1B will be expired soon. I have got a new job offer recently; can I apply for TN visa?


-Yes. J1 waiver or not has nothing to do with TN.


 


被拒的可能性大嗎？


-No.


If I apply, which is better, apply to USCIS or CBP( go to the USA-Canada border)?


-Either way is OK, up to you, but getting the TN-194 at the port of entry is more convenient and quicker.
