回複：急：請各位老師幫忙--有關EAD

我的情況是幾個月前辭去了工作搬到另外一個州。現在找到了新工作。我想就用EAD卡。我485三年前交的。 有EAD， 但從來沒有過。我一直用H-1B工作。

新公司說要看我的勞工卡申請後才能決定我是否可以用EAD.新工作和以前的工作是一樣的。

我和以前的公司聯係但還沒有答複是否可以提供labor certification application. 我的問題是：

（1）如果以前的公司不願意提供我的labor certification information,我就不能用EAD 工作了，是嗎？

-Nonsense! You have the right to work using EAD and it has nothing to do with your previous company.

（2）如果不能用EAD工作，新公司要給我申請H-1B, 那這個H-1B 占每年的名額嗎，

-No.

如果名額用完，我根本就不能到新公司上班了?（我的H-1B was expired, the renewal one was submitted before I quit/expired, not approved when I left)

 

(3) if the H-1B renew has not been revoked, Can new company does H-1B transfer?
