回複:Question regarding 485 filing - to 863211
Would you please explain why concurrent filing 140 and 485 would make 485 approve faster?
-The ealier you file the I-485, the sooner they peoces your I-485 such as name chek, background check, etc. Some people can get the I-140 and I-485 approval at the same time.
I filed 140 (EB2) late last year and it was approved. However, it may take 2-3 years until 485 is current. I am thinking about filing a EB1B next year. I am wondering at the time, should I file 140 - EB1B and 485 together or wait until 140-EB1B approved.
-Depends on how good your qualification for the EB1B. If you think you do not have problem to get the I-140 approved, you may file the I-140 and I-485 concurrently. Otherwise, file I-140 first and then file I-485 after I-140 approval. If your I-140 is denied, you do not need to file I-485 and thus, you can save some money.
Would they check my EB2 based 140 if I file EB1B-140 and 485 at the same time?
-Because you have not file I-485 based on the Eb2 yet, they will not link (not consider) the Eb2 I-140 to your Eb1B case.
