You H1B petition would not be approved.
You are not allowed to come into the US within 3 years if you stay out of status over 180 days. You would be banned out of the US in 10 years if you stay out of status over 1 year.
Negotiate with your employer and do the premium process for your H1B petition asap. You still have time now. Don't wait until the last minute.
