老公的公司是NONPROFIT性質，昨天被LAYOFF，公司讓他４５天內找到工作，否則就買一張機票讓他回去。老公因為三個孩子和沒工作的我，萬分著急。老公的情況是這樣：NIW，PD是２００６年５月１日，４８５遞交於２００７年７月，２００８年我們用了一次AP回國。H１B（不占名額）在今年RENEW了，到２０１３年過期。兩星期前老公遞交了EAD申請，支票已兌。

我急切地想問幾個問題：（１）如果４５天內找不到工作，是不是必須回國。
-No. Your spouse only need to find a job in the same/similar area, and his I-485 will be fine. He can stay in U.S. legally and find a job unless his I-485 is denied (he can use EAD to work if he can not keep his H1). If you and your kids have also filed I-485, you and your kids also can stay in US legally. So, ,don't worry.

（２）公司會不會遞交一份雇傭終止材料給移民局。
-Yes.
如果遞交了，對４８５的裁決和EAD的申請有沒有影響。
-No.
（３）如果找到了工作，H１transfer有沒有時間限製，比如超過４５天。
-If he find a job too late (e.g. > 3 months), his H1 transfer may have a problem and most likey he needs to go out of US to get an H1 visa. But he can use EAD to work, anyway.
