485 pending 期間，因領導堅決留家照顧小孩，嫌麻煩便未給她續EAD, 結果因幫朋友忙，她有一筆小小的收入。 現在USCIS 說沒那段時間EAD記錄，要我們提供材料。

問題1：問題嚴重嗎？
-Yes or not, depends on how long this has happened. If it happened more than 180 days ago from now on, her I-485 may be denied. If less than 180 days from now on, her I-485 will be OK based on INA § 245(k).

問題2: 如何應對？
-If her violation of status happened >180 days ago and if your status is H1, she may go outside US to get an H4 visa to come back to clear the record. Although this may not save her current I-485, she can re-file I-485 if the current pending I-485 is denied.

Living in U.S., keeping your legal status is very immportant. Once you violate the status rule, you may have big trouble.
