No. Once he used EAD, based on 485 pending, if I-140 got denied, he is out of status. He has to leave USA in 10days. Otherwise, he can not enter USA in 3 years or 10 year or forever based on how long he stays in USA illegally

My suggestion is he leaves USA and try H-4.

BTW, H4 can not work in USA. So if ur huby were H4, he would lost the job.
