what do you mean by "已故"的2008 年I-485
2008 RD I-485, so I assume you were EB1 but I-140 denied? And now another EB1 (or marriage GC) concurrent I-485.
Otherwise, if "已故"的2008 年I-485 was denied for other reason, your new I-485 may face the exact same problem.
