回複：H1 職位要求經常出差去中國, 對綠卡有影響嗎?

情況: 我目前和勞工都持H1,485勞工是主申請人, PD 2007年6月, 同時我們每年都申請並更新AP以便TRAVEL. 現在我和勞工公司不約而同都有機會讓我們接受新的職位, PAYROLL 仍留在美國, 但每年超過半年時間要在中國出差. 我們有很多問題希望各位能夠幫助回答.
問題:
在綠卡沒有下來之前, 我和勞工這種情況能否保持H1?
-When you leave U.S., your H1 status is terminated, and when you get an H1 visa to reenter U.S., your H1 status reinstates. So, as long as you get the H1 visa everytime you enter U.S., your h1 status has no problem.

-It should be OK, but you may have AP in hand just in case your GC approval when you are in China (but it is not big because you can ask someone send the GC to you to come back if you do not have AP).


我們新的職位也要求我們經常回美國. 是用H1申請簽證方便還是保持AP?
-H1 visa is better, you had better have AP in hand (do not use it unless you have to).

我們想保持AP, 但AP 每年更新是要求我們必須回美, 我們怕到時候安排不過來. 是不是可以保持AP, 如果AP 更新出現問題,

或舊AP已過期, 新的暫時還沒下來, 到時候再用H1簽證回美?
