Update - DL renew without EAD

Called in DMV yesterdays and talked to someone who sounds like can make decision, been asked few questions and I was surprised they don't really understand immigration law and insist that EAD is the only document that can prove legal presence for a person who stays in US with an AOS receipt ( if without valid visa and GC of course).

At the last told them how about AP and presented them AP I-94 with a valid date on it, then they took it and said can only extend DL to due date of that I-94, glad I finally made it, but some concerns rise:

What if an AOS applicant doesn't have a visa nor AP or EAD? what do we do?
