can h1 pending apply for i-485

my hi vas has been expired on 11/30/2003, and the new h1 visa is pending, i have only notice, still working. asked international office, they said it is security check. in this case, can i still apply for I-485? or should i do premium process to let h1 approved, then apply for I-485?
