my hus went back to china due to J1 rules in 2006.

before he went back to china, he submitted his Eb1a 140 and Eb2(NIW). he got his Eb1a and Eb2(NIW) approved in 2007. recently(2009), he got B1 visa to be back to usa..

so even if you filed 140, (has immigration intend per this forum), he successfully got his B1 visa(nonimmigration visa).

He is going to come to usa to submit his 485 based on his approved EB1a..
