I do not think so. Obviously, in the H-1b extension petition, the ER also asked for the "extenstion of stay" beyond the end of this year. The approved H-1b extension petition will be valid starting from 1/1/2010, and most likely with a valid I-94 form that authorizes the stay from that time. Even this person comes in on the old H-1b and is granted a I-94 that only authorizes the stay until the end of this year. This I-94 form does not necessarily invalidate the I-94 form attached to the appoved H-1B extension (approved while he/she is in China).
