I understand your situation. But your hu*****and company's laywer is not very responsible because they should always ask your status.
Anyways,if you have decided to go back to China for H4 visa, you should leave US asap.Every day you spent here is out of status. email 範毅禹 to see what he says. I think he is a nice guy.
But if I were you, I would try to find out whether to use premium processing to apply H4 in US is feasible.It takes about less 2 weeks and you will know the results.
