You have to overstay (past the expiration) and then file I-751 after divorce, if you can not get your hu*****and to jointly file before expiration. If you are placed in removal proceedings, USCIS will let the immigration court to decide your fate and you are allowed to ask for continuance at the time of your first court appearance, and the judge will adjourn until the divorce is final.
