回複：H1B的特殊問題.

我2001年7月得到H1批準, 同時被lay off. 所以基本上沒用上一天H1.在以後如果需要, 我可以任何時候把2001年的老H1激活.
-I do not think your can 激活2001年的老H1 because you did not work for that H1 at that time (that means you had never had a H1 statu yet).

公司律師說我不用申請新的H1了. 如我申請綠卡, 我可以直接申請勞工卡.
-You can file PERM/I-140 with TN status, but you can not file I-485 and EAD unless you use EB1 category (Priority Date i current). Also, if you file I-140, you can not extend your TN status any more and you can not go out of U.S (when you go outside of US, you will lose your TN status).
