For USCIS to accept your self-employment, having register your own comany or S-corp/LLC is just basic. The company's operation and source of income will be scrutinized, you better have actual contract(s) or agreement with venture capitalist to prove that this company of yours is doing business, not just a company on paper, or company without business. If your company meets the above, it can even sponsor H1B.

What do you mean by "labor certificate but never activated"? Your I-140 is not based on this LC?
