No, you will not out of status

You have already filed H4 extension to CIS before your current H4 expiration. So, when it will approve is not your responsibility. I did same as you before because of my passport expiration date was earlier than H1 holder's. I went to local CIS office to ask advice after I renewed my passport and that was the answer from them. I eventually got less than 3 months gap between two H4 but have no problem to pass my green card application.
