Was your last lawful admission using a visa stamp also your first and only F1 entry? If yes, this can be fatal to the I-485. If you are in H1B now, go to Mexico to get H1B visa stamp and reenter (or spouse is H1B and you leave US to reenter with H4 visa stamp), if no non-immigrant status now, ask your employer to file H1B petition using PPS NOW, and go to Mexico for visa after H1B is approved. All this must be done soon bevause after I-485 denial due to this > 180 days out of status reason, US consulate will not give you H1B visa either. Your I-485 lawyer is very remissed not to make sure your status has been good since your last entry. Lawyer should have found this long ago and asked you to have a visa admission before this I-485 adjudication.
