H1 denied due to payment issue. Got notice about check problem from USCIS.
Made the payment 1 day after the given deadline. Money is taken, but the H1
is denied. The lawyer will work on appeal or re-file. Would this result in out of
status during this appeal or re-file period?
- You will be fine for appeal, may be considered OOS for re-file.

Is H4 application necessary during
this period?
- Your dependent can't file H-4 when your H-1b remains denied.
