請教pjiang,xiao bai tu 和各大俠，H1B transfer, family 問題，叩謝

need H1b transfer because changing job, EB2, filed I-485 (also for family) pending over 1 year. For family information, my son is H4 on my H1b; My hu*****and had his own H1b,he quit job and now is using EAD for own business.
1. Is it necessary to submit I-539 for my kid together with my H1b transfer application?
2. What should I do for my hu*****and’s case? It is ok for him using EAD, or I need to apply H4 for him with my H1b transfer?
