今天問了ISO的老師，他說如果我８月１５號退學就了，I will be out of status, 因為那個cap-gap regulation just applies to student with OPT, I am quiting school, so I don't have OPT and don't grace period。說我必須出境簽。搞的自己都糊塗了。您能再給我確認一下嗎？

F1轉H1， 沒有OPT，(退學). F1身份８月中結束，那從８月15,到１０月１號之間這段可以留在美國嗎？

Yes, if 1) your I-129 is pending, or 2) your H-1b approval came with I-94
