You had better file the H-1 petition as soon as possible and use Premium Processing. If you are out of status for only a few days, you may still have this petition approved with I-94 (one of my friend was out of status for two weeks, and he still got H-1B approved with I-94). But Most likely, your H-1 petition will get approved without I-94. If it is that case, you just need to go to Mexico or Canada to get the H-1 visa to come back.

So, please do not worry too much.
