Did you mix my question with another people's question?

My question is :
My attorney told me today that the problem is once I leave the US,my H-1B will be a consular process H-1B.The approval notice won't have the I-94. Once I return, I will have to file an amended H-1B if I want to be in H-1B status. My status upon return will be AOS+ H1-B pending. Is this right?
