1. You must own AP so your AOS is not consider abandoned. But you can use H1 visa stamp to enter US and start H1 status (after you have H1 I-797 and get visa stamp in Canada)
2. You cannot do COS anyway. The H1 petition part can be approved, but you will need to get H1 visa stamp and re-enter to start H1 status.
