This is a gray zone. Sometimes CIS does not know under which circumstance your employment is. My understanding is that if you valid H-1b overlaps your EAD, you can still consider as H-1, otherwise, if your H-1b is effective after your first day of employment, you will be considered as EAD (or AOS status).
